REGULATIONS FOR PARTICIPATION IN TOURIST EVENTS
EQUI EXPEDITIONS
§ 1. General Information
- These regulations (hereinafter referred to as the “Regulations”) define the rules for participation in equestrian tourism events organized under the Equi Expeditions brand by West Work Service, a limited liability company with its registered office in Opole (45-057 Opole, ul. Ozimska 4/7), Poland, entered into the Register of Entrepreneurs of the National Court Register under the KRS number 0000937371, Tax Identification Number (NIP) 7543346485, hereinafter referred to as the “Organizer.”
- The Organizer operates as a tour operator within the meaning of the Act of November 24, 2017, on tourist events and related tourist services.
- These Regulations constitute an integral part of the agreement on participation in a tourist package concluded between the Organizer and the Client.
§ 2. Definitions
- Client – a natural person who makes a reservation for a tourist event.
- Participant – a natural person who actually participates in a tourist event.
- Tourist event – at least two different tourist services, including accommodation and recreational services in the form of equestrian riding, offered as one complete package.
- Rajd konny – forma imprezy turystycznej o charakterze aktywnym, obejmująca jazdę konną w terenie.
§ 3. Conditions for Participation
- Participant in the tourist event may be a person who has completed 18 years of age.
- An adult participant may register a person under their legal guardianship, who has completed at least 16 years of age, provided:
- submission of a written consent of the legal guardian,
- acceptance by the adult Participant of full responsibility for the minor.
- Participants must not have medical contraindications to participation in equestrian riding and active tourism. The participant’s health condition and physical fitness must allow safe participation in the equestrian event, including multi-hour equestrian riding in open terrain.
- The participant declares that they possess equestrian skills allowing independent and safe movement on horseback in open terrain in three gaits: walk, trot, and gallop.
- The Organizer reserves the right to refuse admission of a Participant to the event or to exclude them from the event during its duration without a right to refund costs if:
- the level of equestrian skills of the Participant proves insufficient,
- the Participant’s behavior endangers their own safety or that of others.
§ 4. Reservation and Conclusion of Contract
- Reservation for participation in the event is made by submitting a participation request and confirming the reservation by the Organizer.
- The contract for participation in the tourist event is concluded at the moment of reservation confirmation and payment of a deposit by the Client.
§ 5. Price and Payments
- The price of the tourist event is stated in euros (EUR) and includes the scope of services specified in the offer.
- In order to confirm the reservation, the Client is required to pay a deposit of 30% of the event price.
- The remaining part of the price, constituting 70% of the event price, is paid once in the period from 30 to 23 days before the start date of the event, based on information provided by the Organizer in the reservation confirmation. Earlier payment of the full amount is voluntary.
- Failure to make timely payment of the remaining part of the price entitles the Organizer to terminate the contract due to default by the Client, with application of cancellation fees.
- The Organizer allows payments in Polish currency (PLN). In such a case, amounts expressed in euros are converted according to the average euro exchange rate announced by NBP on a working day preceding the payment date.
§ 6. Changes to the Program
- The Organizer reserves the right to introduce changes to the routes, travel plans, schedules, horse selection, and order of service delivery if this is justified by safety reasons, weather conditions, participants’ health status, local authority decisions or other circumstances beyond the Organizer’s control.
- The times and distances indicated in the offer are indicative and may be subject to change.
§ 7. Cancellation and Cancellation Fees
- The Client has the right to cancel their participation in a tourist event at any time before its commencement by submitting a written or electronic declaration to the Organizer.
- In the event of a Client’s cancellation, the Organizer charges the following cancellation fees:
- Up to 30 days before the event commencement – withholding of the advance payment in the amount of 30% of the event price,
- From 29 to 23 days before the event commencement – 50% of the event price,
- From 22 days before the event commencement and in the event of a no-show – 100% of the event price.
- Cancellation fees correspond to the actual costs incurred by the Organizer, in particular the costs of booking accommodation, horses, guides, and preparing the event.
- The organizer recommends purchasing individual travel cancellation insurance.
§ 8. Insurance
- Participants in tourist events are covered by NNW and medical treatment costs (KL).
- The Organizer recommends participants purchase additional individual insurance covering particularly high-risk sports.
§ 9. Liability of the Organizer and Participant
- Participant takes part in the tourist event at their own risk, being aware of the risks associated with horse riding and the nature of active tourism.
- The Organizer provides appropriately prepared horses and experienced guides, but does not assume responsibility for injuries or damages resulting from non-compliance with safety rules, instructors’ instructions or this regulation.
- The Organizer does not assume responsibility for delays, changes or cancellations of transportation services carried out by third parties or for additional costs incurred by the Participant as a result.
- The Organizer does not assume responsibility for damages resulting from force majeure or random events.
- Participant bears material responsibility for damages caused by their own fault.
- The Organizer does not assume responsibility for the loss, damage or destruction of participants’ private property, including equestrian equipment, clothing and electronic devices.
§ 10. Minimum Number of Participants
- The operation of a tourist event may be subject to reaching a minimum number of participants.
- In exceptional cases where the required minimum number of participants is not reached, the Organizer may decide to cancel the tourist event and shall inform the Clients thereof within the time limits provided for by applicable law.
- In such a case, the Client shall be entitled to a full refund of all payments made, without any additional fees or compensation.
§ 11. Complaints
- Client has the right to submit a complaint within 30 days of the end of the event.
- Complaints are processed within 30 days of their receipt.
- Complaints must be submitted in writing or electronically.
§ 12. Personal data protection
- Personal data are processed in accordance with applicable laws and the Privacy Policy.
- Detailed information regarding the processing of personal data is contained in the Privacy Policy available on the Organizer’s website.
§ 13. Final provisions
- The agreement for participation in a tourist event and this Regulation are governed by Polish law.
- Any disputes arising from this Agreement will be resolved by the court having jurisdiction over the Organizer’s registered office.
- The Organizer reserves the right to amend the Regulations. The current version of the Regulations is published on the Organizer’s website.
- The Regulations come into effect on the date of publication.
